Practice Areas

Wrongful Dismissal

A wrongful dismissal occurs when an employee is terminated without adequate notice or pay in lieu of notice. An employee can be terminated for just cause or without cause and depending on the circumstances, either can be the basis for a wrongful dismissal claim. If you believe you have been wrongfully dismissed, contact one of the lawyers at OWL LAW to review your matter to determine your proper financial entitlements and next steps.

Constructive Dismissal

A constructive dismissal occurs when the employer imposes a fundamental change to the employee’s job description forcing the employee to resign. Some signs of constructive dismissal include: reduction in compensation by 10%, substantial change to the office location, and unreasonable working conditions related to sexual harassment/discrimination/bullying. If you believe you have been constructively dismissed, contact one of the lawyers at OWL LAW to review your matter to determine your proper financial entitlements and next steps.

Human Rights Claims

All employees in Ontario are protected and have the right to equal treatment under the Ontario Human Rights Code. The most common scenarios in which an employee’s human rights are breached include: ancestry/colour/race, poisoned work environment based on harassment, or physical/mental disability. If you believe your human rights have been breached, contact one of the lawyers at OWL LAW to review your matter to determine your proper financial entitlements and next steps.

Termination Package Reviews

When an employee is terminated without cause, the employer typically provides a termination letter with a Release. The first thing an employee should do after being terminated is to find their employment contract and look for whether there is an enforceable termination clause. If you would like your termination package to be reviewed, contact one of the lawyers at OWL LAW to review your matter to determine your proper financial entitlements and next steps.
